Terms of Service

1. About these terms

Hog3 is the security services brand operated by Donely, Inc. (“Hog3,” “we,” “us” or “our”).

These Terms describe the conditions for using hog3.com and our related online resources. Paid security engagements are governed by a separate written agreement with Donely, Inc., together with the applicable statement of work, testing authorization and scope.

If these Terms conflict with a signed client agreement, the signed agreement controls for that engagement. Visiting our website, requesting a demo or submitting a target does not create a paid engagement or authorize security testing.

2. Business use and authority

Our services are intended for business and professional use.

When requesting services on behalf of an organization, you must have authority to represent it and provide accurate information. You must not impersonate another person or misrepresent your authority over a system, account or organization.

3. Authorized security engagements

Security testing requires valid authorization covering the proposed targets and activities.

For commissioned engagements, the parties must agree on the applicable scope and authorization before testing begins. Depending on the engagement, these documents address:

  • Authorized systems, applications, domains, accounts and environments.
  • Permitted methods, exclusions, testing windows and operational limits.
  • Client contacts, escalation routes and conditions for pausing testing.
  • Access arrangements, evidence handling and reporting requirements.

You are responsible for obtaining any necessary permissions from system owners, hosting providers or other third parties. Your authorization cannot extend to systems or data you have no authority to include.

Changes to scope require approval through the agreed engagement process. These website Terms do not independently authorize anyone to test Hog3 or third-party systems.

4. Client cooperation and safe operation

Clients must provide accurate scoping information, identify relevant restrictions and maintain appropriate operational contacts during testing.

Backup arrangements, restoration responsibilities and any precautions required before testing should be agreed for the engagement. Clients must promptly notify Hog3 of changes that could affect authorization, safety or scope.

We may pause affected activities if authorization is unclear, unexpected sensitive data is encountered, a safety concern arises or continuing could exceed the agreed scope. Resumption will follow the applicable escalation and approval process.

5. Automated tools and AI-assisted work

Hog3 may use automated tools and AI-assisted systems to support authorized testing, analysis and report preparation.

Use of these tools remains subject to the agreed scope, applicable data-handling requirements and human accountability. Automation does not expand authorization or permit otherwise prohibited activities.

Any proposed handling of regulated or sensitive client data must follow the applicable contractual and provider requirements. Clients should not send credentials or sensitive engagement data through public website forms.

6. Findings and limitations

Security assessments evaluate the agreed scope using the methods, access and time available for the engagement.

An assessment cannot guarantee discovery of every vulnerability, prevent every incident or establish that a system is completely secure. Findings may become outdated as systems, configurations and threats change.

Reports describe the observations and limitations of the assessment. Unless separately agreed, clients remain responsible for remediation and ongoing operation of their systems.

An assessment or report does not itself constitute certification, regulatory approval or a guarantee of compliance.

7. Fees, scheduling and cancellation

Fees, payment dates, expenses, delivery schedules, cancellation arrangements and any refund rights are specified in the applicable written agreement or accepted order.

Website descriptions and indicative pricing do not replace the agreed engagement terms. Additional work or scope changes must follow the agreed change process.

8. Confidentiality and personal data

Confidentiality obligations and the handling of client engagement data are governed by the applicable client agreement and, where required, a data processing agreement or other relevant agreement.

Our Privacy Policy explains how we handle personal data, including website inquiries and business contact information. Our Cookie Policy describes cookies and similar technologies.

Retention, return and deletion of engagement data are subject to the applicable agreement, legal requirements and documented preservation obligations.

9. Intellectual property and reports

Hog3 and its licensors retain their rights in the website, branding, pre-existing tools, methodologies, templates and other materials they own.

Clients retain their rights in the systems, information and materials they provide. Ownership of engagement deliverables and the client’s rights to use or share them are specified in the applicable agreement.

You may view and use public website content for legitimate informational purposes. These Terms do not grant permission to redistribute restricted materials, remove ownership notices or use Hog3’s name or branding to imply endorsement.

10. Acceptable website and account use

You must not use our website or related online resources to:

  • Gain unauthorized access to systems, accounts or data.
  • Submit targets for testing without appropriate authority.
  • Disrupt services or bypass access restrictions.
  • Upload malicious content outside an expressly authorized testing arrangement.
  • Misrepresent your identity or provide unlawfully obtained information.
  • Violate applicable law or another party’s rights.

Where account access is provided, you must protect your credentials and promptly report suspected unauthorized use through your agreed support contact. Account access must follow the permissions and sharing arrangements approved for that service.

11. Third-party services

Our website and services may link to or use third-party services, including scheduling, communications and infrastructure providers.

Third-party services may have their own terms and privacy notices. A link does not imply endorsement. Our responsibilities for third-party services used in a paid engagement are governed by the applicable client agreement.

12. Website availability and liability

We aim to keep website information useful and accurate, but it may contain errors or become outdated. We may update, restrict or discontinue website features.

To the extent permitted by applicable law, public website content is provided “as is” and “as available,” without a guarantee of uninterrupted availability or suitability for a particular purpose.

Warranties, remedies and liability limits for paid services are governed by the signed client agreement. Nothing in these Terms excludes liability or rights that cannot lawfully be excluded.

13. Suspension and termination

We may restrict website or account access where reasonably necessary to address misuse, security risks or legal requirements.

Suspension or termination of a paid engagement, including any resulting payment, data-return or deletion obligations, is governed by the applicable client agreement.

14. Changes to these terms

We may update these Terms and will display the effective date of the revised version. Where required, we will provide notice or obtain agreement before applying material changes.

Updates to these website Terms do not automatically amend an existing signed client agreement.
